1. Description of Services

Top Tools AI provides access to AI-powered models and tools that run on our servers. Our models process the inputs you submit ("Prompts") only for the duration necessary to generate a response, and are designed around the following principles:

• Enterprise-grade security: The Services are built with security controls appropriate for business use.
• Zero data retention: We do not save, log, or cache your Prompts or the model outputs generated from them beyond the time needed to process and return a response.
• No training on your data: Your Prompts and outputs are never used to train, fine-tune, or otherwise improve our models.

2. Eligibility and Accounts

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Services. If you use the Services on behalf of a company or other entity, you represent that you have the authority to bind that entity to these Terms.

3. Acceptable Use

You agree not to use the Services to:

• Violate any applicable law or regulation.
• Infringe the intellectual property or privacy rights of others.
• Generate content that is unlawful, harmful, fraudulent, or abusive.
• Attempt to reverse-engineer, probe, or bypass the security of the Services.
• Interfere with or disrupt the integrity or performance of the Services.

4. Your Content

You retain all rights to the Prompts you submit and the outputs you receive, subject to any third-party rights and applicable law. Because we do not retain Prompts or outputs after processing, we have no ability to access, review, or recover your content once a session ends.

5. Data Handling Summary

Our models run on our servers and hold your Prompts only for the duration required to generate and deliver a response. We do not view, save, or cache Prompts as a matter of course. For full detail on how data is handled, see our Privacy Policy.

6. Service Availability

We aim to keep the Services available and performing reliably, but we do not guarantee uninterrupted or error-free access. The Services may be modified, suspended, or discontinued at any time, without notice. This includes changing, renaming, adding, or removing models, features, underlying providers, rate limits, usage limits, and pricing. Such changes do not entitle you to a refund, credit, or compensation.

7. Purchases, Delivery, and Refunds

Paid access plans automatically renew at the selected 3-day, 30-day, or 90-day interval until canceled. By purchasing a plan, you authorize Top Tools AI and Stripe to charge the payment method on file at each renewal. You may cancel future renewals through the available billing controls or by contacting support; cancellation takes effect at the end of the current paid period.

All sales are final. Top Tools AI does not provide refunds, except where required by law that cannot be waived. Payments for digital access, model access, subscriptions, renewals, credits, balances, and other Services are non-refundable and non-cancellable once completed. We do not provide refunds, partial or prorated refunds, credits, exchanges, or cash conversions for unused access time, unused credits or balance, a change of mind, dissatisfaction with outputs, service changes or outages, or failure to use the Services after purchase. Canceling a subscription stops future renewals but does not refund the current paid period. Digital access or purchased balance is delivered immediately to the Top Tools AI account associated with the checkout, and by purchasing you request immediate delivery.

You agree to contact us before initiating any chargeback or payment dispute. Disputes over authorized, delivered purchases may result in account suspension or termination and forfeiture of remaining access, credits, or balance. Full details are in our Return & Refund Policy.

8. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. AI-generated outputs may be inaccurate or incomplete, and you are responsible for evaluating outputs before relying on them.

9. Limitation of Liability

To the fullest extent permitted by law, Top Tools AI will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Services.

10. Changes to These Terms

We may change, update, or replace these Terms, our Return & Refund Policy, and our Privacy Policy at any time, for any reason, without prior notice and without notifying you individually. Changes take effect immediately when posted on our website or within the Services, and the "Last Updated" date will be revised.

By accepting these Terms once, whether at sign-up, at checkout, or by using the Services, you also agree to all future versions of them. Your continued use of the Services, or any further purchase or renewal, after a change is posted confirms your acceptance of the updated Terms. It is your responsibility to review these pages periodically. If you do not agree with a change, you must stop using the Services and cancel any renewals.
